Welcome to Clyro! These Terms of Service (“Terms”) govern your access to and use of the Clyro website and services, as well as any purchase of products from Clyro’s online store. In these Terms, “Clyro”, “we”, “us”, or “our” refer to the operator of the Clyro online store, and “you” or “your” refer to you as the user or customer. This document includes important provisions standard to e-commerce, such as eligibility requirements, order and shipping policies, returns, intellectual property rights, warranty disclaimers, liability limitations, governing law, dispute resolution, and more (An Overview of Key Legal Considerations for E-commerce Businesses – Terms.law). Please read these Terms carefully. By using our website or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the site or services.

1. Eligibility & Acceptance of Terms

Legal Age: By accessing or using Clyro’s site or services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), or that you are using the site under the supervision of a parent or legal guardian who agrees to these Terms. If you are under 18, you may use our services only with involvement of a parent or guardian. Clyro does not knowingly offer products or collect information from children without appropriate consent, in compliance with applicable laws.

Accepting the Terms: By visiting clyrofit.com, creating an account, or purchasing a product, you acknowledge that you have read, understood, and agree to these Terms. This forms a legally binding agreement between you and Clyro regarding your use of our site and purchase of products. If you do not agree with any of these provisions, you should stop using the site immediately. Your continued use of the site signifies acceptance of these Terms.

Use of the Site: You agree to use clyrofit.com only for its intended purposes (such as browsing products, placing orders, and obtaining information) and in compliance with all applicable laws and regulations. You must not misuse the site by attempting to harm its functionality or security, by introducing viruses, hacking, sending spam, or by engaging in any fraudulent or illegal activities. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe a user is violating these Terms or any law.

2. Accounts and Personal Information

Account Creation: You may be allowed to create an account on our site for a faster checkout, to save preferences, or to track orders. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for restricting access to your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

Account Responsibility: You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately. We are not liable for any loss or damage arising from your failure to safeguard your account credentials. Clyro may, in its sole discretion, refuse registration, cancel an account, or terminate user access if we suspect fraudulent, abusive, or unlawful activity, or any violation of these Terms.

Personal Data: Your submission of personal information through the store is governed by our Privacy Policy (available on our website). Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using the site or placing an order, you consent to the collection and use of personal data as described in the Privacy Policy.

3. Placing Orders

Order Process: When you place an order on the Clyro website, you are making an offer to purchase the selected product(s) from us. After you submit an order and payment, we will send you an order confirmation email acknowledging that we have received your order. This confirmation is not yet an acceptance of your offer; it is a confirmation that we received your request. We reserve the right to accept or decline your order after this confirmation.

Order Acceptance: A binding purchase contract is only formed when we have processed and shipped your order. We will notify you by email once your order has been shipped (shipment confirmation). If we are unable to fulfill all or part of your order for any reason, we will let you know and will not charge you for unfulfilled items (or will refund any such amounts if already charged).

Processing Time: We strive to process and fulfill orders promptly. Orders are generally processed within 1-3 business days (Monday through Friday, excluding holidays) of receipt. If there is any significant delay in processing your order, we will contact you via the email or phone number provided with your order. Please note that processing times are separate from shipping transit times.

Right to Refuse or Cancel: Clyro reserves the right to refuse, cancel, or limit any order at our discretion. Some situations that may result in your order being canceled or modified include, for example:

  • Product Unavailability: If a product is out of stock or discontinued, we may cancel that item from your order. We will inform you of any such cancellation or offer alternative options if available.

  • Payment Issues: If your payment cannot be processed or is not verified, or if the billing information provided is incorrect, we may delay or cancel the order.

  • Fraud Prevention: If an order appears to be fraudulent or unauthorized (for instance, if it triggers our security controls or if we suspect it was placed with a stolen credit card), we may cancel the order.

  • Pricing or Description Errors: Despite our best efforts, a product listed on our site may be mispriced or contain an error in the description. If we discover an error in the pricing or product details of an item you have ordered, we reserve the right to cancel or correct the order. If the actual price is lower than what you paid, we will refund the difference. If the actual price is higher, we may contact you for instructions before shipping or cancel your order and notify you of the cancellation.

  • Multiple Quantity Limits: We may limit or cancel quantities purchased per person, per household or per order, particularly if we suspect orders are being placed by dealers, resellers, or distributors in violation of these Terms.

If we cancel your order in whole or in part, we will attempt to notify you using the contact information you provided at the time the order was made. If your order is canceled after your credit card (or other payment method) has been charged, we will issue a refund for the canceled items to your original payment method.

Order Cancellation by You: If you need to cancel or change your order, please contact us as soon as possible at our support email (see Contact Us section below). We will do our best to accommodate your request. However, once an order has been processed or shipped, we may not be able to cancel it. In such cases, you may need to wait until you receive the item and then initiate a return (see Returns & Refunds section) if applicable.

4. Payment Methods

Accepted Payment Methods: Clyro accepts multiple payment methods to make your shopping experience convenient. We currently accept:

  • Credit/Debit Cards: We accept major credit and debit cards such as Visa, MasterCard, American Express, and Discover.

  • PayPal: You can pay using your PayPal account balance or linked payment methods via PayPal.

  • Apple Pay: We support Apple Pay for users who wish to checkout quickly using saved card details on their Apple devices.

  • Google Pay: We support Google Pay for a fast checkout using payment methods saved to your Google account.

  • Klarna: We offer Klarna as a payment option, which may allow you to Buy Now, Pay Later or split your purchase into installments (availability of Klarna’s services may vary by country). Please note: If you choose to pay with Klarna, you will be subject to Klarna’s terms and conditions in addition to our Terms.

Payment Timing: By placing an order, you agree to pay the full price of the products, any applicable shipping charges, and any taxes or fees that may apply. All payments must be made at the time of order placement (except where Klarna or similar services allow later payment under their terms). Your order will not be processed until payment is successfully completed and authorized. If the issuer of your payment method refuses to authorize the transaction, we reserve the right to cancel your order.

Pricing and Currency: All prices on our website are listed in U.S. Dollars (USD) unless otherwise stated. If you are purchasing from outside the United States, your payment provider might charge you in your local currency at an exchange rate set by them, or you may incur additional fees (such as foreign transaction fees) from your bank or card issuer. Clyro is not responsible for any currency conversion fees or bank charges. The total amount you will pay (including product price, shipping, and any applicable taxes) will be shown at checkout before you confirm your order.

Taxes: Prices on our site do not always include sales tax, VAT, or other similar taxes unless explicitly stated. If any such tax is applicable to your order, it will be calculated and added at checkout based on your shipping address and applicable law. You are responsible for paying any such taxes. For example, orders shipped to certain U.S. states may include sales tax, and orders to countries that impose a Value Added Tax (VAT) or Goods and Services Tax (GST) will include those amounts as required by local law.

Billing Information: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You must promptly update your account and other information, including your email address, payment card numbers, and expiration dates, so that we can complete your transactions and contact you as needed. Providing false or inaccurate billing information may result in order delays or cancellation.

Third-Party Payment Processors: Payments on our site may be processed by third-party payment gateways and processors (such as PayPal, Stripe, Apple Pay, Google Pay, Klarna, etc.). These third-party services are responsible for the processing of your payment information. By using a third-party payment method, you agree to the terms of service and privacy policy of those payment providers. Clyro does not store your full credit card number or other sensitive payment details on our servers; such information is handled by the secure payment processor. While we implement security measures to protect your data, we are not responsible for errors or security breaches by these third-party processors. If you encounter payment issues related to the third-party service (for example, a problem logging into PayPal or a Klarna credit approval issue), you may need to resolve those with the appropriate provider.

Payment Security: All transactions are encrypted via Secure Socket Layer (SSL) technology or equivalent security measures to protect your payment information. However, no method of transmission over the internet or electronic storage is 100% secure. By completing a transaction, you represent that you are authorized to use the payment method and that you authorize us (or our third-party payment processor) to charge the full amount to that payment method.

5. Shipping & Delivery

Shipping Locations: Clyro is a U.S.-based business (operating out of Connecticut, USA), but we proudly ship our products internationally. We offer shipping to customers in a variety of countries worldwide. During the checkout process, you will be able to select from available shipping destinations. If your country or region does not appear as an option, unfortunately we may not ship to that location at this time.

Shipping Carriers and Methods: We use reputable shipping carriers (e.g., USPS, UPS, FedEx, DHL, or local postal services) to deliver orders. The shipping options (standard, expedited, etc.) and carriers available will be displayed at checkout based on your shipping address. The choice of carrier may depend on your location and the shipping method you choose. We reserve the right to change the selected carrier after you place an order (for example, to ensure faster delivery or for logistical reasons), but this will not affect the shipping speed or cost you selected.

Delivery Time Estimates:

Estimated delivery times begin after your order has been processed and shipped. Processing typically takes 1–3 business days. Transit time varies by region:

  • United States:

    • Standard Shipping: 3–7 business days

    • Expedited Shipping (if available): 1–3 business days

  • Europe:

    • Standard Shipping: 7–15 business days

    • Expedited/Tracked Options (if selected): 5–10 business days

  • Rest of the World (ROW):

    • Standard International Shipping: 7–15 business days

    • Delivery to remote areas or regions with limited postal infrastructure may take up to 4–6 weeks

Please note that all timelines are estimates and may vary due to customs delays, weather conditions, or high-volume periods (e.g., holidays).

Shipping Costs: Shipping charges will be calculated and shown at checkout before you complete your order.  We are to free shipping on all orders above 50$. The general costs depend on factors such as the destination, shipping method chosen, and the weight/size of the items. 

Ownership and Risk: All orders are shipped from the United States. Title to the products you purchase (meaning legal ownership) and risk of loss or damage to the products passes to you once we deliver the package to the carrier. This means that during shipping, the package is essentially under your ownership. However, we will do our best to assist you in case of any shipping issues. If a package is lost in transit or arrives damaged, please contact us so we can help resolve the issue with the carrier (we may file a claim on your behalf or assist in replacement, depending on circumstances).

Customs, Duties & Import Taxes

For international shipments, please be aware that your order may be subject to import duties, VAT, or other taxes, depending on your destination.

  • For customers in the EU, Clyro is IOSS-registered, which means we collect VAT at checkout for orders under €150. This allows for faster delivery and no surprise fees at the border.

  • For orders above €150, import VAT and duties may still apply and will be collected by the shipping carrier or customs authority upon delivery.

For non-EU countries, you may still be responsible for local import taxes, duties, or customs clearance fees. These are not included in the item prices or shipping fees shown at checkout (unless specifically stated).

🛃 Important:

  • You are responsible for any customs duties and taxes imposed by your country, unless we explicitly state otherwise at checkout.

  • If you refuse to pay import duties or taxes and the package is returned to us, we can refund the item(s) — minus any return shipping fees and original shipping costs, which are non-refundable.

We recommend checking with your local customs office for specific guidance on your country’s policies.

Address Accuracy: Please ensure that the shipping address you provide is complete and correct. Include all relevant information such as apartment or unit numbers. We will ship to the exact address provided. We cannot guarantee delivery if the address is entered incorrectly or incompletely. If a package is returned to us due to an incorrect address or if it was unclaimed, we will contact you for an updated address, and you may be responsible for paying additional shipping fees to resend the package.

Undeliverable or Refused Shipments: If a shipment is refused by the recipient or deemed undeliverable (for example, if you are not available for delivery or do not pick up the package from the carrier when required), it may be returned to us. In such case, we may issue a refund for the merchandise minus the shipping costs (since the carrier will charge us for the return shipping). If you would like us to re-ship a refused package, additional shipping charges will apply.

Partial Shipments: If your order contains multiple items, we will typically ship them together. However, in some cases (e.g., item on backorder or coming from different warehouse), we may split the shipment. You will not be charged extra for split shipments beyond what was shown at checkout. We will notify you if an order will be fulfilled in multiple shipments.

Delivery Issues: Once the carrier marks an order as “delivered,” it is considered delivered. If you have not received your package but tracking shows delivered, check around your premises and with neighbors or household members. If it still cannot be found, contact us and we will assist in investigating with the carrier. Note that we are not automatically liable for packages marked as delivered. We encourage you to choose a secure delivery location. For high-value orders, we may require a signature confirmation upon delivery (you will be notified if we do so).

6. Returns & Refunds

We want you to be happy with your purchase from Clyro. If you are not satisfied with a product, our returns policy allows eligible items to be returned for a refund or exchange, subject to the terms below.

Return Period: We offer a 30-day return window for most products. This means that if you wish to return an item, you must initiate the return within 30 days of the date you received the item (delivery date). If more than 30 days have passed since you received your purchase, we unfortunately cannot offer a refund or exchange (unless a longer period is required by law in your jurisdiction).

Eligibility for Returns: To be eligible for a return or exchange, the item must meet the following conditions:

  • Original Condition: The product should be unused, unworn, and unwashed, and in the same condition that you received it. This means it should not show signs of wear, damage, or alteration.

  • Original Packaging: The item must be returned in its original packaging, including any branded boxes, tags, labels, manuals, or accessories that were included with it. For example, if the product came sealed or with tags attached, it should be returned in that state (unless the reason for return is a defect discovered after opening).

  • Proof of Purchase: A receipt, order confirmation email, or other proof of purchase is required to process a return. Providing your order number associated with the purchase will usually suffice.

If all the above conditions are met, we will proceed to process your return as described. If items returned to us do not meet these conditions (for instance, if they are worn or missing parts not due to our error), we reserve the right to deny the refund or issue a partial refund at our discretion.

Return Process: To initiate a return or exchange, please follow these steps:

  1. Contact Us: Email our customer support at support@clyro.com (or use our Contact Us form on the website) within 30 days of receiving your item. Please include your order number, the item(s) you wish to return, and the reason for the return (this helps us improve our products and service).

  2. Receive Return Instructions: Our team will respond with instructions on how to return your item. This will include the return shipping address (note: do not send the product back to the manufacturer or to our corporate address unless we specify — returns must go to our designated returns facility). We may also provide you with an RMA (Return Merchandise Authorization) number or label that needs to be included with your return.

  3. Pack and Ship: Securely pack the item in its original packaging (or equivalent protective packaging if original is not available).

    Unauthorized returns or returns sent to any other address may not be processed.

    Include the proof of purchase and any RMA or return authorization paperwork. Ship the item using the carrier of your choice. We recommend using a trackable shipping service and purchasing shipping insurance for high-value items. You are responsible for the item until it reaches us, so tracking and insurance protect you in case the package is lost or damaged in transit. Please send the item to the exact return address we provide.

Condition of Returned Items: Once we receive your returned item, we will inspect it. We will send you an email notification to let you know we have received your return. We will also inform you of the approval or rejection of your refund based on the condition of the item and its eligibility (A Sample Refund Policy for E-commerce). If the return does not meet our criteria (for example, if the item is found to be used or damaged by the customer, or if it’s outside the return window), we may decline the refund and can ship the item back to you (you may be responsible for the shipping cost of sending it back). In some cases, at our discretion, we might offer a partial refund if that is reasonable (for instance, if an item is returned missing minor components or past the 30-day period by a small margin, we might deduct a restocking fee and process the remainder as a refund).

Refunds: If your return is approved after inspection, we will process your refund. The refund will be applied to your original method of payment (e.g., refunded to the same credit card or PayPal account you used for purchase). Please note:

  • It may take a few business days for the refund to be officially posted by your bank or credit card company. The timing for funds to be available can vary by financial institution.

  • We will refund the purchase price of the item minus any non-refundable shipping charges (as noted above) or return shipping fees (if we provided a label and indicated we’d deduct the cost). You will receive an email confirming that the refund has been issued.

  • If you paid any customs duties or import taxes on an international order, we unfortunately cannot refund those, as they were paid to your government. You may check with your country’s customs office on whether such taxes can be reclaimed.

If a partial refund is granted (for example, if an item is returned in a used condition not due to our error), we will communicate the reason and amount to you.

Late or Missing Refunds: If you are expecting a refund and haven’t received it after we’ve confirmed the refund on our end, first check your bank or credit card account again. Then contact your credit card company or payment provider, as it may take some time (commonly 5-10 business days) before the refund is officially posted to your account. If you’ve done all this and you still have not received the refund, please contact us at support@clyro.com so we can assist you.

Exchanges: If you wish to exchange an item for a different size, color, or a replacement (for the same product), the fastest way is often to place a new order for the desired item and return the original item to us for a refund. However, if you prefer a direct exchange (e.g., exchanging a defective item for a working one, or swapping sizes), please contact us with your request. We will let you know if the exchange is possible (subject to stock availability). For exchanges of the same item due to a defect or damage during shipment, we will typically ship the replacement at no additional cost to you. If the exact item is not available for an exchange (e.g., it’s out of stock or discontinued), we may offer you an alternative or process a refund.

Gifts: If an item was purchased by someone else and shipped to you as a gift, and you wish to return it, a couple of scenarios are possible:

  • If the original purchaser initiates the return, the refund will go back to their original payment method.

  • If you (the gift recipient) initiate the return, and the item was marked as a gift at purchase and shipped directly to you, you may choose to receive your refund in the form of a store credit or gift card for the value of your return, so that you (the recipient) can use it on our site. The original purchaser will not be notified of your return in that case. 

  • If the item wasn’t marked as a gift (meaning it was shipped to the buyer who later gave it to you), we will need to refund the original purchaser’s payment method, which will alert them to the return.

When contacting us about a gift return, please provide the order number or purchaser’s details if possible, to help us locate the transaction.

We reserve the right to modify our return and refund policy for special circumstances (for example, extended return periods during holiday seasons, which will be communicated on our website when applicable). For any questions regarding returns, you can always reach out to our support team.

7. Intellectual Property

Ownership of Content: Unless otherwise indicated, all content and materials on the Clyro website – including but not limited to text, descriptions, product images, graphics, logos, button icons, videos, audio clips, downloads, data compilations, and software – are the property of Clyro or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws. Clyro and/or its licensors own all intellectual property rights for the material on the Clyro website. All such rights are expressly reserved.

Trademarks: The trademarks, service marks, logos, and trade names used and displayed on our site (including the name “Clyro” and the Clyro logo) are proprietary to Clyro. Other trademarks and logos that appear on our site are the property of their respective owners and are used with permission. Nothing in these Terms or on our site grants you, directly or indirectly, a license or right to use any Clyro trademark, logo, or trade name without our prior written permission.

Permitted Use of Site Content: You are authorized to access and use the content on our website for your personal, non-commercial use (such as viewing product information or making purchases). You may print or download portions of the site content for your personal use, such as saving an order confirmation or product description for reference, but only if you retain all copyright and proprietary notices as they appear in such materials.

Prohibited Uses of Content: You must not engage in any of the following without our express prior written consent:

  • Reproduction or Redistribution: You may not copy, reproduce, republish, upload, post, transmit, or distribute any part of the site or its content for public or commercial use. For example, you cannot take product images or descriptions from our site to use on your own site or platform.

  • Modification or Derivative Works: You may not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based upon any software or content on the site.

  • License or Sell: You may not sell, rent, lease, loan, or sublicense the site or any content or materials obtained from the site.

  • Framing or Scraping: You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Clyro without written consent. You may not use any “meta tags” or any other “hidden text” utilizing Clyro’s name or trademarks.

  • Any Unlawful Use: You may not use the content for any illegal purpose or in violation of any applicable laws or regulations, or in any manner that could harm the reputation of Clyro or the rights of any third party.

User-Generated Content: If our site allows you to post reviews, comments, or other content (“User Content”), you retain ownership of any intellectual property rights that you hold in that User Content. However, by submitting any User Content on our site or social media pages, you grant Clyro a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media (for example, we might display a product review you wrote on our site or use a photo you tagged us in, for promotional purposes). You also agree that any User Content you submit will not violate any third-party rights (such as copyright or privacy rights) and will not be unlawful, abusive, or objectionable. We reserve the right to remove or edit user submissions for any reason.

Intellectual Property Infringement Claims: We respect the intellectual property rights of others. If you believe that any content on the Clyro site infringes your copyright or other IP rights, please notify us with detailed information so that we can investigate. We comply with the Digital Millennium Copyright Act (DMCA) and other applicable laws concerning removal of infringing content. Our designated agent for notice of copyright infringement can be reached via the contact information in the Contact Us section below.

8. Third-Party Links and Services

Third-Party Links: Our website may contain links to third-party websites or services that are not owned or controlled by Clyro (for example, links to blogs, social media, or partner sites). We provide these links for your convenience or to provide additional information. Please note that inclusion of any link does not imply endorsement by Clyro of the site. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.

Third-Party Services: Similarly, our site may integrate or offer services from third parties (such as payment processing by PayPal or Klarna, or an embedded Instagram feed, etc.). If you choose to use these services, be aware that you may be subject to the terms and conditions and privacy policies of those third parties. For example, if you use PayPal to complete your purchase, PayPal’s user agreement will govern your relationship with PayPal.

No Liability for Third Parties: Clyro shall not be liable for any loss or damage that may arise from your use of third-party websites or services. Any activities you engage in in connection with a linked site or third-party service are between you and that third party. We encourage you to read the terms and conditions and privacy policy of any third-party site or service that you visit or utilize.

9. Disclaimer of Warranties

As-Is Basis: Clyro provides the website, its content, and all products and services on an “as is” and “as available” basis, without any warranty of any kind, express or implied. This means that while we strive to maintain high quality, we do not guarantee that the site or products will meet all your expectations or requirements, or that the site will be available on an uninterrupted, secure, or error-free basis. No Express or Implied Warranties: To the fullest extent permitted by applicable law, Clyro disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability (that a product is of average acceptable quality and fit for the ordinary purposes for which such product is used), fitness for a particular purpose (that a product is suited for your intended use), title, non-infringement, and any warranties arising out of course of dealing or usage of trade (Disclaimer of Express and Implied Warranties Sample Clauses | Law Insider). We do not warrant that the quality of any products, services, information, or other material purchased or obtained from us will meet your expectations or that any errors on the website will be corrected.

Product Descriptions and Information: While we endeavor to provide accurate and useful information on our site, including product descriptions, images, specifications, and customer reviews, we do not warrant that this material is error-free, complete, or current. For example, product colors may appear differently on different displays; we cannot guarantee that your monitor’s display of any color will be accurate. If a product offered by Clyro is not as described, your sole remedy is to return it in unused condition for a refund, as per our Returns & Refunds policy.

No Warranty for Availability: We do not guarantee that the website will always be available or that it will be free from viruses or other harmful components. However, we will make reasonable efforts to maintain the security and functionality of the site. You are responsible for implementing sufficient safeguards (like antivirus software) to satisfy your requirements for safety and reliability.

User’s Responsibility: You understand that any information or advice obtained through the Clyro site or service, whether written or oral, does not constitute any warranty not expressly stated in these Terms. You assume all responsibility for any damage or loss that may result from downloading or using any content, information, software, or product from the site.

Exceptions: In certain jurisdictions, the law might not allow the exclusion of certain warranties. Nothing in these Terms will exclude or limit any warranty or consumer right that cannot be excluded or limited under law. For example, if you are a consumer in a jurisdiction that provides you mandatory statutory protections (such as warranties or guarantees under consumer protection laws), those protections are not waived by this agreement. The disclaimers above apply except where prohibited by law.

Specific State Law Rights: (USA) Some states do not allow the disclaimer of implied warranties or limitations on how long an implied warranty lasts, so the above disclaimers may not apply to you in full. If you are a resident of a state or country that provides you specific legal rights, you may have those rights in addition to those listed here.
